Pennsylvania physician pleads guilty to drug and sex crimes

HARRISBURG, Pennsylvania — A Pennsylvania physician accused of using drugs and alcohol to lure boys for sex pleaded guilty Monday to seven charges in a deal that carries a 10- to 20-year prison sentence.




Dr. Barry Lee Bender, 56, pleaded guilty to performing oral sex on two boys under the age of 16, providing booze to minors at parties, conspiring to purchase ecstasy and cocaine, and distributing prescription narcotics improperly.

"Over the last 10 years, he had been involved in basically sponsoring parties, get-togethers, that involved the use of alcohol and drugs, and later sexual offenses," said Michael Madeira, the senior deputy attorney general who prosecuted the case. The alcohol charges involve parties held in Clinton, Blair and Centre counties from 1999 to 2001.

Bender's plea bargain preempted opening statements at his criminal trial, which had been scheduled to begin Monday in Blair County, Pennsylvania Common Pleas Court. Bender was slated for trial on 33 counts, and the seven charges to which he pleaded guilty amount to "everything that represents his activity over the whole time period," Madeira said.

Under the agreement, sentencing will be delayed until mid-December so Bender can visit his elderly mother in Florida. His lawyer said Bender also has serious health problems and will seek additional treatment in the coming two months. He remains free on bail but must report to the county probation office at least three times a week.

The medical license held by Bender, a family practitioner now living in Clearfield County, Pennsylvania was suspended for two years in December 2001. The guilty pleas will result in a permanent revocation, Madeira said.

Bender's defense attorney, Thomas M. Dickey, said Bender does not acknowledge having committed all of the actions involved in the seven charges. Dickey said the guilty plea was motivated by a belief that, despite questions about the reliability of witnesses, as many as 16 people would testify against Bender.

"If they get believed and some of the junk sticks ... I think at a minimum he would have probably gotten a 30-year minimum sentence," Dickey said.

Madeira said "whatever motivated him," Bender pleaded guilty. "However he perceives it in his mind, that's entirely up to him. He still pleaded guilty to it in open court."

Bender pleaded guilty to two counts of involuntary deviate sexual intercourse. The boys who were victims in those cases were not physically coerced, but because they were both under age 16 at the time, the charges met the requirements of the criminal statute, Dickey said.
